General
Please peruse these Terms of Use carefully. Accessing or using this website, constitutes acceptance of these Terms of Use (“terms”), as such may be revised by The Kava Society Limited from tim to time, and is a binding agreement between the user (“you”) and The Kava Society Limited governing the use of the website. If user does not agree to these terms, user should not access or use this website. These terms contain disclaimers and other provisions that limit our liability to user.
In the event there is any conflict or inconsistency between these Terms and any other terms of use that appear on the Sites, these Terms will govern. However, if you navigate away from the Sites to a third-party site, you may be subject to alternative terms and conditions of use, as may be specified on such site, which will govern your use of that site.
Nothing in these terms and conditions limits your rights under the Consumer Guarantees Act 1993 where you are a consumer for the purposes of the Act.
This website is operated by The Kava Society Limited, New Zealand. When you buy something from our online store, you will be buying from The Kava Society Limited, Suite 10152, 17B Farnham Street, Parnell, Auckland, New Zealand.
Privacy
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
We value your privacy and we will never share your order, personal or payment details with anyone, unless required to do so by New Zealand law. We will only use your contact information if we need to get in touch about your order.
You will be added to our mailing list only if you opt in, you are free to unsubscribe at any time.
Payment and Security
We use Stripe or Paypal for your payments. Stripe use data encryption and real-time fraud prevention technology to keep your information secure, reducing the risk of online fraud. We pay a fee to the payment processor on each transaction, and rely on their expertise in secure payment processing, allowing us to stick to what we do best: sourcing and supplying some of the world’s finest kava.
Your card information is not captured or stored at any time on our website. To find out more about the security that Stripe or Paypal apply to your payment, please visit Stripe or PayPal’s website.
Payment of your order is always in New Zealand Dollars (NZD).
Shipping and Delivery
Please refer to our Shipping & International Orders for detailed information about our shipping charges and supported destionations. We aim to dispatch all orders within 1 working day.
New Zealand Orders
All New Zealand orders are shipped via NZ Post courier service. We aim to dispatch all orders on the next business day after your order is placed. A tracking number will be emailed to you upon dispatch so you can monitor your delivery.
Please allow 1-3 business days for delivery within New Zealand. If you are in a rural area, please allow an extra 2 days for delivery.
We guarantee the delivery of orders to valid and correct addresses in New Zealand.
International Orders
International orders are shipped via NZ Post international service or DHL, depending on your destination. We aim to dispatch all orders on the next business day after your order is placed.
If you order from outside of New Zealand, you accept full responsibility for the package once it leaves New Zealand. This includes:
- Any and all import taxes, duties, customs charges or brokerage fees
- Compliance with all local customs and regulatory requirements
- Providing accurate delivery information and following your local postal service's instructions
- Accepting delivery
Failed International Deliveries
We cannot offer refunds for international orders that cannot be delivered due to:
- Incorrect or incomplete address provided by the customer
- Customer refusal to accept delivery
- Non-payment of customs duties, taxes or other charges
- Failure to collect the package from the local postal service or customs office
- Non-compliance with local customs or import regulations
If an international order is returned to us in New Zealand in its original, unopened condition, we may, at our sole discretion, offer a partial refund. Any such refund will be calculated as the original order value minus:
- Original shipping costs
- Return shipping costs to New Zealand
- A 10% restocking fee
In case of lost items, we may be able to file a claim with New Zealand Post, provided you notify us within 30 days of placing your order.
Returns and Refunds
We want you to enjoy your kava so if you have any concerns or things weren’t what you expected then please let us know. We don’t offer refunds for change of mind or because something isn’t to your taste, however if there is a quality issue we will make it right. We’ll always meet our legal obligations around refunds and returns.
All orders received are final and goods or service will be shipped as per the order form, so please make sure you double-check your address. If it’s too late though and you see a mistake, drop us a line and we will do our best to make the change for you. If you receive your order and something is amiss, contact us through the details on the bottom of your order email. We will handle errors on a case-by-case basis. We do ask that you raise any issues promptly with us. If you don’t do this, we might not be able to offer a refund, especially if the delay means we can’t verify the problem. Refunds will be made via the same payment method you used when placing your order.
Order Cancellations
All orders are final once placed. As a general rule, we do not accept requests to cancel orders due to change of mind. This is because:
- Our fulfillment centre processes orders overnight and in the early morning hours
- We cannot guarantee we will receive your cancellation request during business hours before processing begins
- Order cancellations involve administrative effort and may incur fulfillment fees that we must pay
In limited circumstances where it may be feasible to cancel your order (for example, if we receive your request before processing has begun), we may, at our sole discretion, agree to cancel your order. In such cases, we reserve the right to charge a cancellation and restocking fee of 10% of the order value (minimum $10).
If you believe you need to cancel your order, please contact us immediately. However, please note that we cannot guarantee we will be able to accommodate your request.
Pricing
All prices are displayed in either New Zealand dollars (NZD) or your local currency, clearly indicated at the time of browsing and purchase. The currency displayed will depend on your location and the payment method selected.
For New Zealand-based orders, GST is included in all displayed prices. Freight charges are added at the checkout and payment section of the online shop.
Prices may increase or decrease from time to time. The prices shown at the time you complete your purchase are the prices you will pay.
Intellectual Property
Our website and all of the material on it is protected by copyright and other intellectual property rights (IP) that belong to The Kava Society Ltd, or that we have a permission to use on our website. We ask you to respect these rights. You must not copy, reverse engineer, adapt, modify, transmit, post or distribute, whether electronically or otherwise, any material from our website.
If you want to use some of the information we have please send us a written request and we will be in touch regards whether the use of our or others’ intellectual property is permissible.
Errors, Inaccuracies or Omissions on This Website
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
